Acceptable Use Policy
As a provider of web site hosting, domain registration, ecommerce, software applications and other Internet-related services,
TriGem Solutions Web Site/Servers offers its clients, and their customers and users, the means to disseminate a wealth
of public, private, commercial, and non-commercial information. TriGem Solutions Web Site/Servers respects
that the Internet provides a forum for free and open discussion and dissemination of information,
however, when there are competing interests at issue, TriGem Solutions Web Site/Servers reserves
the right to take certain preventative or corrective actions. In order to protect these competing
interests, TriGem Solutions Web Site/Servers has developed an Acceptable Use Policy ("AUP"),

which supplements and explains certain terms of each user/customer's respective service agreement
and is intended as a guide to the user/customer's rights and obligations when utilizing TriGem
Solutions Web Site/Servers services. This AUP will be revised from time to time. A user/customer's use
of TriGem Solutions Site/Web Servers after changes to the AUP are posted on TriGem Solutions Web
Servers web site, www.trigemsolutions.com & www.trigeminfotech.com, will constitute the user/customer's acceptance of any
new or additional terms of the AUP that result from those changes. |

Guidelines governing acceptable use of web site/services by the user
A. TriGemSolutions.com features two types of marketplaces, and TriGem Solutions's role and responsibilities vary in each such marketplace.
TriGem Solutions Direct Marketplace. TriGem Solutions itself is the seller of the products / services offered in TriGem Solutions Direct Marketplace.
TriGem Solutions undertakes responsibility for all aspects of the transaction and the product/services listing, including product/service descriptions, identification of quantities, promotions and offers,
establishment of reserve requirements (if any) and shipping.
TriGem Solutions Partner / Merchant Marketplace. TriGem Solutions Partners / Merchants are TriGem Solutions approved third-party partners / merchants who sell their products / services on the Site through Affiliation.
In this program, the Partner / Merchant is the seller of the product / service and TriGem Solutions is the service provider. To ensure TriGem Solutions buyers the ability to shop in a private and secure environment, every TriGem Solutions Partner / Merchant must go
through a thorough verification process and trade references before they are approved to list products / services on the Site. These Partners / Merchants list their items directly and assume responsibility for all aspects of their
product / service listings and shipping. TriGem Solutions does not own, warehouse, ship or otherwise manage any inventory or goods offered by its Partners / Merchants. Buyers are advice to check the Term & Conditions and Privacy Policies
of the Partner / Merchant web site(s).
B. TriGem Solutions Payments. TriGem Solutions currently accepts credit card/debit card payments for orders in the TriGem Solutions Direct Marketplace and TriGem Solutions Partner / Merchant Marketplace they have their own
payment methods and gateways.
C. The User certifies that he/she is at least 18 (eighteen) years of age or has the consent of a parent or legal guardian.
E. All prices, unless indicated otherwise are in USD (US Dollar).
F. All prices and availability of products / services are subject to change without prior notice at the sole discretion of TriGem Solutions.
G. TriGem Solutions reserves the right to refuse or cancel any order placed for a product /service that is listed at an incorrect price. This shall be regardless of whether the order has been confirmed and/or payment been levied via credit card.
In the event the payment has been processed by TriGemSolutions.com the same shall be credited to your credit card account and duly notified to you by email.
H. In a credit card transaction TriGem Solutions will not be liable for any credit card fraud. The liability to use a card fraudulently will be on the user and the onus to 'prove otherwise' shall be exclusively on the user
I. Any request for cancellations of orders once duly placed on the site, shall not be entertained unless as stated in money back offers.
J. In the event that a non-delivery occurs on account of a mistake by you (i.e. wrong name or address) any extra cost incurred by TriGem Solutions for redelivery shall be claimed from the User placing the order in TriGem Solutions Direct Marketplace.

K. TriGem Solutions shall not be liable for any delay / non-delivery of purchased goods by the user from TriGem Solutions, partners, merchants, vendors, trade organisations, manufacturers, shop etc., flood, fire, wars, acts of God or any cause
that is beyond the control of TriGem Solutions.
L. The User agrees to provide authentic and true information. TriGem Solutions reserves the right to confirm and validate the information and other details provided by the User at any point of time. If upon confirmation such User details are found not to be true (wholly or partly),
TriGem Solutions has the right in its sole discretion to reject the registration and debar the User from using the Services of trigemsolutions.com and / or other affiliated websites without prior intimation whatsoever.

Guidelines governing acceptable use of services by the web hosting customer
A. Storage or distribution of pirated software or data is not
allowed. TriGem Solutions reserves the right to inspect any and all files
stored on its servers to ensure compliance with this policy.
B. TriGem Solutions servers or services must not be used knowingly
to violate the laws and regulations of INDIA or any other nation,
or the laws and regulations of any state, city, province or other local
jurisdiction in any material way. TriGem Solutions will cooperate
with any legitimate law enforcement activity or investigation.
C. Pornography, nudity and other sex related content is prohibited.
This includes sites that may infer sexual content, or link to adult
content elsewhere. Further examples of unacceptable content or links
include pirated software, warez sites, or any other kind of hacked
or illegal software. D. Customer will avoid violation
of generally accepted guidelines of Internet usage.
E. Customer accounts and passwords are confidential. The customer is
expected to maintain these customer accounts and passwords as such,
and Customer is solely responsible for all activities related to their
customer accounts and passwords. F. Mass e-mail distributions or
transmission of unsolicited e-mail are not allowed. TriGem Solutions has
a zero tolerance policy and reserves the right to terminate any Customer
account upon first learning of any such offense.
G. Server based functions such as cgi programs must not jeopardize
the integrity of the operation, performance or security of the server.
H. TriGem Solutions is very happy to offer very generous bandwidth
allowances to its customers so they may build their web presence without
concern of usage constraints. While most customers may never need the
extra bandwidth, others may try to take advantage of the generous
allowance in ways for which it is not intended. TriGem Solutions has
established some common sense rules to avoid this. Customer may not
resell or give away web space under Customer's account. Customer may
not use Customer's site to store files for other IP addresses or
domain names, nor may Customer use Customer's site as a primary repository
for image, data, warez, wav, or mp3 files. Greeting card, and FFA
link scripts are disallowed. I. Surcharges may be imposed when
any site has considerable effects on system performance or resources.
TriGem Solutions is the sole and final arbiter on determining what
conduct or activity is considered a violation of policy, what qualifies
for a surcharge, and what the amount of surcharge should be.
J. TriGem Solutions will notify the Customer of the intention to
impose a surcharge if corrective action is not taken. Customer's
continued use of TriGem Solutions services after receipt of notification
of the intention to impose a surcharge, and Customer's failure to take corrective
action, constitutes Customer's acceptance of the proposed surcharge.
K. TriGem Solutions reserves the right to limit or terminate services
to any Customer at any time for any reason, or for no reason at
all. If termination is not for any reason, and if practicable, TriGem
Solutions will give Customer at least 20 days oral, written or electronic
advance notice of the date on which termination will occur.

1. Notices
All notices needed, required or permitted to be given
to TriGem Solutions shall be in writing and sent via postal mail to TriGem
Solutions, Pune INDIA office address.

2. Parties Bound
This Agreement shall be binding upon the parties hereto,
and their respective heirs, administrators, representatives, executors, successors and assigns.
|
|
3. Captions
The captions contained herein are not a part of this Agreement. They
are only for the convenience of the parties and do not in any way
modify, amplify, or give full notice of any of the terms, covenants or
conditions of this Agreement.
|
|
4. Governing Law
This Agreement shall be construed in accordance with the laws of INDIA under PUNE jurisdiction.

|
5. Entire Agreement
This Agreement contains the entire Agreement between TriGem
Solutions and User / Customer; there are no other terms, covenants, obligations
or representations, oral or written, of any kind whatsoever. No modifications
shall be made to this Agreement except by unanimous consent in writing signed
by TriGem Solutions and User / Customer.

including TriGem Solutions Web Servers and its clients, as responsible members of the Internet.
